THIS TERMS OF USE AND PRIVACY NOTICE (“TERMS”) GOVERN YOUR ACCESS TO AND USE OF THE WEBSITE LOCATED AT WWW.CEUS-SSC.COM (THE “SITE”) AND CONSTITUTE A BINDING, LEGALLY ENFORCEABLE AGREEMENT BETWEEN YOU AND THE AUTHORS. GENERAL SITE DESCRIPTION AND PRIVACY PRACTICES:

• The Site is being provided by EPRI for the limited purpose of providing access to information about a project conducted by EPRI, with funding made possible through a grant awarded by the DOE and the NRC as summarized in the report published at the Site entitled “Central and Eastern United States Seismic Source Characterization for Nuclear Facilities” (the “Report”).

• EPRI does not intend to collect any personal information from You in connection with Your use of the Site. However, as You view the Site, You may encounter hyperlinks to certain other web sites (“Linked Sites”). If you choose to visit any Linked Site, You will be leaving the Site and these Terms will not apply to Your activities on such Linked Site. Rather, Your activities will instead be subject to the Terms of Use and Privacy Policy published by such Linked Site, which may require You to provide personal information, including national residence or citizenship information for export control purposes. YOU SHOULD ALWAYS READ THE TERMS OF USE AND PRIVACY NOTICE OF ANY EPRI SITE CAREFULLY BEFORE PROVIDING INFORMATION OR USING SUCH EPRI SITE.

• With respect to hyperlinks to any third party websites not owned or maintained by EPRI, such hyperlinks are offered for Your convenience only and do not constitute any approval, endorsement, sponsorship, affiliation or guarantee by EPRI with respect to the organization sponsoring/maintaining such sites or

• When You use the Site, EPRI’s hosting provider, Network Solutions, may automatically collect certain technical, routing, server log and other information for internal purposes, such as to administer and improve the Site. PROHIBITED USES:

The Site and the Report are both provided subject to the following restrictions:

• You will not use the Site or any portion of the Site to violate or attempt to violate probe, scan, or test the vulnerability or to breach security or authentication measures of any system or network associated with the Site.

• You will not use the Site, the Report, or any portion of either, to provide material support or resources to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to Section 219 of the Immigration and Nationality Act or any successor law(s) thereto;

• You will not use the Site, the Report, or any portion of either, to violate any applicable local, state, regional, national or international law, and any regulations having the force of law.

SITE CONTENT:

To the extent the Site or Report includes any logos, trademarks, trade names, or service marks (“Logos”), such Logos are the exclusive property of their respective owners and are protected under United States and foreign trademark and other laws. “Electric Power Research Institute” and the “EPRI” logo are trademarks of EPRI. The “U.S. Department of Energy,” “U.S. Nuclear Regulatory Commission” and any government logos or seals are the property of the United States Government. You may not reproduce, download or otherwise use any Logos except as permitted by applicable law or without the prior written consent of the appropriate owners thereof.

Except for the Logos, if any, the Authors grant to You a worldwide, royalty-free, non-exclusive, perpetual (for the duration of the applicable copyright) license to reproduce, distribute, store, display, publicly perform, and create derivative works of the Site, the Report, and all elements thereof (the “Works”) in all media and formats whether now known or hereafter devised, subject to the following restrictions:

a. You must keep intact all notices and disclaimers of warranties with every copy of the Works.
b. You must keep intact all copyright notices and provide: (a) the name of the Authors; (b) the title of the Work; and (c) the URL for the Site.
c. You may not implicitly or explicitly assert or imply any connection with, or sponsorship or endorsement by any of the Authors.

EXPORT RESTRICTIONS:

LIMITATIONS LIABILITY:

To the greatest extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall EPRI be liable for any damages whatsoever, including direct, indirect, exemplary, punitive, special, or consequential damages that result from the use or, or the inability to use, the Works or any portion thereof, even if EPRI has been informed of the possibility of such damages.

You agree to defend, indemnify, release, and hold harmless EPRI, DOE, NRC, and their affiliates, and respective members, officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from Your use of the Works or any portion thereof or Your breach of the Terms.

THE WORKS ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EPRI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR WARRANTIES AS TO NONINFRINGEMENT.
